The Website and Service are intended for users aged 16 and older.

2. Scope of Service

Hivebuilder provides an online platform that enables users to create, manage, and collaborate on software architecture diagrams, documentation, and related content. We offer both free and paid subscription plans. Payments are processed securely through Stripe.

3. Account Registration

To use the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You agree to:

  • Provide accurate and complete registration information;
  • Keep your information current; and
  • Immediately notify us of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Intellectual Property

Unless otherwise stated, the Website, Service, and all associated source code, design elements, graphics, text, and trademarks (collectively, "Content") are owned or licensed by Blugri software+services BV. The Content is protected by copyright, trademark, and other intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Website and Service solely for their intended purposes. You may not:

  • Copy, modify, or create derivative works of the Website, Service, or Content;
  • Reproduce, resell, or commercially exploit any part of the Service;
  • Use our trademarks or logos without permission;
  • Use automated tools (robots, scrapers, data mining, etc.) to access the Service; or
  • Remove or alter any copyright or proprietary notices.

5. Customer Content

You may create, upload, or share content through the Service ("Customer Content"). You retain full ownership of your Customer Content.

By uploading or creating Customer Content, you grant Hivebuilder a limited, worldwide, non-exclusive, royalty-free license to:

  • Host, store, process, display, and transmit the content as necessary to operate and improve the Service.

You represent and warrant that:

  • You own or have the necessary rights to your Customer Content; and
  • Your use of the Service does not infringe any third-party rights or violate any law.

We may remove Customer Content that violates these Terms or is unlawful, harmful, or infringing.

6. AI-Generated Content

Hivebuilder integrates artificial intelligence technologies (including Microsoft Azure AI Foundry) to assist users in generating text, diagrams, or other outputs.

AI-generated outputs are provided "as is." While we take reasonable steps to ensure data privacy and service reliability, AI outputs may contain errors, omissions, or inaccuracies and should not be relied upon as factual, complete, or professional advice.

By using AI-powered features, you acknowledge and agree that:

  • You remain solely responsible for reviewing and validating any AI-generated content;
  • You will not use AI-generated content in ways that violate laws, intellectual property rights, or ethical standards; and
  • Hivebuilder disclaims all liability for damages arising from your reliance on or use of AI-generated outputs.

7. Acceptable Use

You agree not to use the Website or Service to:

  • Violate any law or regulation;
  • Upload or distribute malware, spam, or harmful code;
  • Harass, threaten, or impersonate others;
  • Interfere with or disrupt the security or functionality of the Service; or
  • Reverse-engineer, decompile, or attempt to extract source code from the Service.

We reserve the right to suspend or terminate accounts that engage in prohibited behavior.

8. Subscription and Payments

If you purchase a paid plan, you authorize Hivebuilder (through Stripe) to charge your selected payment method. Subscription fees are billed in advance and are non-refundable, except where required by law.

You may cancel your subscription at any time; your plan will remain active until the end of the current billing period.

We reserve the right to change pricing with prior notice. Updated pricing applies from the next billing cycle.

9. Termination

You may terminate your account at any time through the Service or by contacting us at info@hivebuilder.io.

We may suspend or terminate your access to the Service if:

  • You violate these Terms or applicable law;
  • Your account remains inactive for an extended period; or
  • Continued operation of your account poses a security or compliance risk.

Upon termination, your right to use the Service ends immediately. We may retain or delete Customer Content as described in our Privacy Policy.

10. Disclaimer of Warranties

The Website and Service are provided "as is" and "as available", without warranties of any kind. We do not guarantee that the Service will be error-free, secure, or uninterrupted.

To the fullest extent permitted by law, Hivebuilder disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Hivebuilder, its directors, employees, and affiliates shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages;
  • Loss of data, revenue, profits, or business opportunities; or
  • Any claim exceeding the total amount paid by you to Hivebuilder in the 12 months preceding the event giving rise to the claim.

AI-generated outputs and any actions taken based on such outputs are expressly excluded from liability.

12. Indemnification

You agree to indemnify and hold harmless Blugri software+services BV, its affiliates, and personnel from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Website or Service;
  • Your violation of these Terms; or
  • Your Customer Content or use of AI-generated outputs.

13. Modifications and Interruptions

We may modify or discontinue any part of the Website or Service at any time without notice. We are not liable for interruptions, downtime, or data loss resulting from maintenance, updates, or technical issues.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Belgian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Belgium.

15. Electronic Communications

By using the Website or Service, you consent to receive electronic communications from us. You agree that all communications, agreements, and notices sent electronically satisfy any legal requirement that such communications be in writing.

16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blugri software+services BV regarding your use of the Website and Service.

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations to affiliates or successors.
